Booking Terms & Conditions 2023

ARTICLE 1 – BOOKING TERMS

1.1 The holidays and rental units offered by the “La Plage du Dramont” Campsite are family-oriented. The “La Plage du Dramont” Campsite retains the right to refuse any reservation which would go against its purpose.

1.2 Reservations for a pitch or a rental unit are made on a strictly personal basis. Transfering or subletting reservations without the “La Plage du Dramont” Campsite’s express written consent is prohibited. Otherwise, the “La Plage du Dramont” Campsite reserves the right to cancel the reservation and retain the full booking price in respect of non-material harm.

1.3 The “La Plage du Dramont” Campsite is free to accept or refuse booking requests, depending on availability and generally, circumstances thatare likely to affect the proper performance of the Contract between the Parties.

1.4 Pitch rental: the basic package includes the site for the tent, caravan or camping-van for 1 to 2 persons, access to reception & sanitary facilities.
A pitch can accommodate a maximum of 6 people.
Equipped rental units: the basic package is appropriate for 2 people. The stay of any
additional person will be charged.

1.5 The “La Plage du Dramont” Campsite retains the right to refuse access to its establishment to families or groups of people whose number exceeds the maximum capacity of the rented pitch or accommodation. The Customer is fully informed that “non-accompanying persons”, according to the meaning of the Rental agreement, are prohibited from staying overnight on the “La Plage du Dramont”’s Campsite.

1.6 The “La Plage du Dramont” Campsite accepts group bookings – which are defined as bookings – for family purposes – of more than 4 rental units made by the same individual or by different individuals staying during the same period of stay.

ARTICLE 2 – BOOKING & PAYMENT POLICY

2.1 The indicated prices are “starting from” and valid only for the 2022 Season. They correspond to one night’s stay – in Euros, VAT included.
The indicated prices do not include cleaning fee, transportation costs, tourist tax, the deposit, the Cancellation Insurance fee and Booking fee.
All prices are fixed and binding upon signature of the Rental agreement.
The Customer is fully informed of the dynamic rates that evolve over the season. The indicated prices – preceded by the words “starting from” – are the best available rates during the opening period of the establishment.
The prices will be increased depending on the combination of two criterias, namely:
- A dynamic multiplier coefficient – specific to each period – will be applied depending on the booking period and the establishment’s occupancy rate;
- Advance bookings will benefit from bonus rates – which cannot lower the prices below the reference rates (displayed rates).
Given the above and the active role of the Customer in determining the rate applicable to his stay which depends on the advance booking – the “La Plage du Dramont” Campsite cannot, under any circumstances, be held responsible for a difference of cost between two stays booked for the same period.

2.2 The rental period in high season runs from 3rd of July, 2022 to 28th of August, 2022. During this period, rentals are weekly: from Saturday to Saturday for rental units and from Sunday to Sunday for pitches.
In low season, arrivals and departures can be any day and any time of the week.
The applicable rates depending on the type of accommodation are specified on the current price list namely as “rate per night”, “weekly rates”,“weekend rates” – applies to bookings of at least 2 or 3 nights.

2.3 At the time of booking, the Customer agrees to pay to the “La Plage du Dramont” Campsite:
- 30% of the total price of the stay: at the time of your Booking;
- 40% of the total price of the stay: 90 days before the arrival date provided for in said the Agreement;
- 30% of the total price of the stay (the balance): 30 days at the latest before the arrival date provided for in the said Agreement.

2.4 The Customer agrees to pay the full price of the stay to the “La Plage du Dramont” Campsite for any booking made less than 30 days beforethe arrival date provided for in the Rental agreement.

2.5 In addition to the price of the stay, the Customer must pay a booking fee of €36.00 including tax in high season (from 3rd of July, 2022 to 28th of August, 2022) or €16.00 including tax in low season.

2.6 The Customer is fully informed that holiday vouchers are not accepted by the “La Plage du Dramont” Campsite.

2.7 Your Booking will be confirmed with the express consent of the “La Plage du Dramont” Campsite:
- Paper form booking: on receipt of your Rental agreement (duly completed, dated and signed), the Booking Terms & Conditions (duly dated and signed) and your payment;
- Online booking: on receipt of your payment and by accepting of the Booking Terms & Conditions.

ARTICLE 3 – ABSENCE OF A WITHDRAWAL RIGHT

In accordance with the Article L. 221-28 of the French Consumer Code, the fourteen-day right of withdrawal period does not apply to contracts for the provision of accommodation – provided at a set date or during a determined period.

ARTICLE 4 – CANCELLATION & AMENDMENT OF THE BOOKING

4.1 Cancellation of the stay by the “La Plage du Dramont” Campsite

In the event of cancellation of your stay by the “La Plage du Dramont” Campsite, the Customer will obtain reimbursment of the total price of the stay. However, in no way it will give rise to the payment of damages.

4.2 Cancellation of the stay by the Customer

In the event of cancellation of the stay by the Customer, costs will be covered by the “Cancellation Insurance” fee (only if this option was subscribed by the Customer when booking his stay).
Cancellation Insurance fee (for pitches): The fee refers to 3% of the total amount of the Client’s stay. The minimum amount cannot be less than € 20.00 for the entire stay.
Cancellation Insurance fee (for rental units): The fee refers to 3% of the total amount of the Client’s stay. The minimum amount cannot be less than € 30.00 for the entire stay.
Please note that none of the services offered by the “La Plage du Dramont” Campsite are subject to the right of withdrawal set out in article L. 221-28 of the French Consumer Code. Hence, any cancellation of a booking made by the Customer – after the date of booking and before the date of arrival – will have the following impact:
- In the event of a cancellation made within 60 days of the planned date of arrival, the “La Plage du Dramont” Campsite keeps the full 70% deposit paid by the Customer;
- In the event of a cancellation made within 30 days of the planned date of arrival, the Customer has an obligation to pay the total price of the stay.

4.3 Amendment of the booking
The amendment of the booking can be requested by the Customer regarding his stay at the “La Plage du Dramont” Campsite. The amendment may relate to the dates of the stay and/or the type of accommodation. The wishes of the Customer must be given in writing (letter or e-mail) as soon as possible. The “La Plage du Dramont” Campsite reserves the right to accept or reject the Customer’s request (depending on availability).

4.4 Unused services
Any interrupted and/or shortened stay (in the event of late arrival and/or early departure) by the Customer cannot give rise to a refund by the “La Plage du Dramont” Campsite.

ARTICLE 5 – STAY RULES

5.1 Arrival
The current price list for the “La Plage du Dramont” Campsite defines arrival & departure days.
Rental unit: the Customer may check-in from 4 p.m. The Customer will be given the keys of the rental unit and will have to pay a deposit of € 250.00 and € 80.00 (by two separate cheques, credit card or cash) upon arrival.
Pitch: the Customer may check-in from 1 p.m.

5.2 The stay
The Customer agrees to comply with the “La Plage du Dramont” Campsite’s internal regulations.
The Customer & the accompanying persons must be covered for their civil liability. The “La Plage du Dramont” Campsite does not accept any liability in case of any incident involving the liability of the Customer. The Customer is hereby informed that he/she is responsible for the care of his/her personal items.
The Customer is responsible for nuisance and disruption caused to other visitors by his guests or people visiting him/her.
Wearing a permanent bracelet is compulsory for the Customer and his guests during the entire stay.
Wearing boxer-style swimming trunks or shorts is not permitted in the swimming pool.
Minors must be accompanied by their parents or legal guardians.

5.3 Departure
Pitches must be vacated by 12 p.m. on the day of the departure as indicated on the Rental agreement.
Rental units must be vacated by 10 a.m. on the day of the departure as indicated on the Rental agreement. Late checkout (up to 4pm) of rental units is permitted on Sundays – only applicable for “weekend rates”.
The accommodation shall be left perfectly clean, so that the inventory may be checked. Any breakage or damage will be charged, along with any repairs to the premises.
At the end of the stay, the “La Plage du Dramont” Campsite shall return the deposit to the Customer after deduction of compensation retained, on production of supporting invoices, against possible damage ascertained during the departure inventory.
The “La Plage du Dramont” Campsite reserves the right to request additional compensation from the Customer, if the costs exceed the amount of the deposit initially retained.
In the event that the accommodation has not been cleaned before the departure of the Customer, a cleaning fee of € 80.00 incl. tax must be paid by the Customer.
The “La Plage du Dramont” Campsite reserves the right to invoice the Customer an additional night (in accordance with the current price list) for any delay ensuing from a late departure.

ARTICLE 6 – ANIMALS

6.1 The “La Plage du Dramont” Campsite accepts pets (with the exception of 1st and 2nd category dogs) against payment of a price indicated on the Rental agreement, when booking the stay. A valid vaccination record for cats & dogs is compulsory.
6.2 Two pets are allowed per reservation.
6.3 Authorised pets must be kept on a leash at all times.
6.4 The presence of authorised pets is prohibited around swimming pools, in food shops & in buildings.

Article 7 – IMAGE RIGHTS

7.1 The Customer authorises the “La Plage du Dramont” Campsite – or a substitute – to be photographed, recorded or filmed during his stay, as well as the use of said images, sounds, videos and recordings on all graphic, optical, digital supports and/or electronic media (in particular on the website, Facebook and Instagram page of the “La Plage du Dramont” Campsite), for publicity of said Campsite, and on travel or tourist guides – with the exclusive aim of promoting and advertising of the “La Plage du Dramont” Campsite. Under no circumstances will the “La Plage du Dramont” Campsite – or a substitue – intend any slight on the Customer’s or his guests’ honour.

7.2 The authorisation granted by the Customer for himself and his guests is free of charge & valid for all countries for a five year period.

ARTICLE 8 – GOVERNING LAW

The contract for the provision of accommodation (“Rental agreement”) concluded between the “La Plage du Dramont” Campsite and the Customer is governed by French law.

ARTICLE 9 – DISPUTE

Any complaint related to non-compliance of services with regard to contractual obligations must be given in writing (namely by recorded delivery letter or by e-mail) and sent to the “La Plage du Dramont” Campsite or to its Head Office, at the address given below:

MEDIATION:
In the absence of a satisfactory response, the Customer has an option to opt for mediation. In this case, the Customer shall file his claim by writing (a recorded delivery letter) to SAS HUISSIERS 06, Bailiffs in Nice, at the address given below, after the expiration of a one month period from the receipt of his correspondence by the recipient.

ARTICLE 10 – DISCLAIMER

10.1 The Customer expressly acknowledges that the “La Plage du Dramont” Campsite cannot be held liable regarding the communication – by its partners or by any third party – of false information mentioned in the brochure or the websites concerning the residential premises, and particularly its photographs, descriptions, acrtivites, leisure activities, services and dates of operation.

10.2 All photographic images and informational content contained in the brochure and the “La Plage du Dramont” Campsite’s website are noncontractual and are only indicative.

10.3 The Customer expressly recognises that certain activities and facilities offered by the “La Plage du Dramont” Campsite – specified in the brochure description or on its website – may be cancelled, particularly when due to adverse weather conditions or force majeure, as defined by French law.

ARTICLE 11 – DATA PROCESSING & FREEDOM LAW

Personal data communicated by the Customer, at the time of booking, will not be transmitted by the “La Plage du Dramont” Campsite to any third party – such information is considered to be confidential.
Personal data communicated by the Customer will be used exclusively by the Internal Services of the “La Plage du Dramont” Campsite for the processing of reservations, in order to improve and personalise communication & the supply of services for Customers – based on your interests.
In accordance with the French Act 78-17 on Data Processing, Data Files and Individual Liberties, the Customer is entitled to access, modify, rectify or delete his personal data at any time. In order to do so, the Customer must file a request to the “La Plage du Dramont” Campsite (at the address mentioned below) and indicate his Surname, First name and address.
